英美对色情报复立法

近期，英美国家相继对那些因与前女(男)友分道扬镳而心有不甘，将两人大尺度亲密照放到网上达到"黑对方后快"的恶行立法，如今，这种网上"色情报复"(revenge porn)行为将被定罪、判刑。

英美对 On Sept 1, a new Texas law goes into effect that criminalizes posting intimate photos of a partner that were sent that were sent with the understanding they remain private on the Internet. Posting "revenge porn" will now be a class A misdemeanor which can come with up to $4,000 in fines and a possible year in jail.

今年9月1日，美国德克萨斯州一项新法即将生效。该法将对网络"色情报复"行为定罪。所谓的网络"色情报复"，是指在未经当事人允许的情况下，将那些被认为仍属私密的，与伴侣亲热的照片放到网上公开。如今，犯此类罪行将被判为A级轻罪，犯法者将被判上交多达4000美元的罚金，还可能被判入狱一年。

无独有偶，英国在今年2月12日也颁布了类似法案。在英格兰和威尔士，此类刑事犯罪最高刑期为两年(up to two years in jail)。

There has been an explosion in revenge porn over the past few years, largely because of the impact of new technology.

Victims of revenge porn have found it difficult to have pictures removed from the Internet.

According to information from eight police forces in England and Wales which kept data on this issue, there were 149 allegations of revenge porn made in the past two and a half years.

The new law seeks to give a stronger option - classing revenge porn as "photographs or films which show people engaged in sexual activity or depicted in a sexual way or with their genitals exposed, where what is shown would not usually be seen in public".

新法对"色情报复"做出了更明确的界定，以便受害者寻求法律保护。公开发表显示某人在进行性行为，或有性动作或有暴露性器官的照片或视频，将构成"色情报复"。
