Thai law enforcement authorities said Thursday that they intend to file murder charges against former Prime Minister Abhisit Vejjajiva and his deputy, Suthep Thaugsuban, for the death of a taxi driver whom a court ruled was shot by soldiers during a bloody anti-government rally in 2010.

The planned indictment by the Department of Special Investigation, Thailand's equivalent of the U.S. Federal Bureau of Investigation, is only one step in a long legal process and Mr. Abhisit does not face immediate arrest. It is the first planned indictment related to his administration's handling of the marathon protests that blocked off parts of central Bangkok and led to a security crackdown on the often violent demonstrations that led to the deaths of more than 90 people.

DSI chief Tharit Phengdit said Mr. Abhisit was potentially responsible for the death of taxi driver Phan Kamkong for allegedly authorizing the use of live ammunition against protesters, based on a ruling by Thailand's Criminal Court that the driver was killed by military personnel.

Then, the case will be transmitted to the office of Thailand's Attorney General for approval, and then the independent courts also will have to agree to accept the case before the pair go to trial.

Mr. Abhisit, Mr. Suthep and their lawyers could not immediately be reached for comment. Democrat Party spokesman Chavanond Intarakomalyasut said the DSI's decision to press charges is politically motivated and that law enforcers are rushing to charge the two politicians to prevent them from invoking parliamentary immunity from prosecution when the next legislative session begins Dec. 21. 'However, I would like to confirm that both of them (Mr. Abhisit and Mr. Suthep) stand ready to fight the legal battle and will not run away,' Mr. Chavanond said.

The 2010 streets protests followed a period of intense turmoil after a military coup ousted Mr. Thaksin in 2006. Mr. Abhisit took over as premier when the pro-Thaksin government collapsed.

Prinya Thaewanarumitkul, a law professor at Thammasat University, said that while the decision follows normal judicial procedures, 'it will inevitably have a substantial political impact.'
