电影审查制度拟入法 偷漏票房、插播广告将被罚款

近日，写有电影审查制度的电影产业促进法草案提请全国人大常委会审议，这是继2011年12月电影法征求意见稿公布后，该项法律草案终于进入人大初审环节。

The draft sets guidance on aspects of film censorship and advertising input in films. It forbids any content concerning perversion of history, and the showing of films without a license can be fined as high as 20 times the illegal gains.

草案中就电影审查制度、电影放映期间不得播放广告等作出规定，禁止电影片中含有歪曲历史的内容，并明确规定，放映未取得《电影公映许可证》的电影，最高可处违法所得20倍的罚款。

据悉，电影审查制度写入电影产业促进法草案(be written into the draft)中意味着，法律草案审议通过后，电影审查制度将由国务院条例(regulation)上升为法律(law article)。

草案规定，摄制完成的电影(a finished film)需送国务院或省(区、市)电影主管部门(State Council or its provincial (autonomous regional, municipal) department)审查，30日内作出审查决定(censorship decision)，准予公映的发放《电影公映许可证》，不准予公映的，书面通知(written notice)申请人并说明理由。

[简化审核流程]

草案还对电影剧本备案审查制作(the censorship of film scripts)出规定。与现行政策相比，草案简化了审查流程(simplifying the process)，取消一般题材电影剧本(screenplays with nonsensitive themes/general themed scripts)审查，改为将电影剧本梗概(storylines)向国务院或省(区、市)电影主管部门备案，涉及宗教、民族、外交等特殊题材的电影剧本(special themed scripts)则仍需审查。

[加重处罚力度]

按照现行规定(the current regulation)，摄制(shooting)、洗印加工(developing)、进口、发行、放映(screening)含有禁止内容的电影片将没收违法所得(illegal gains)并处罚款，违法所得5万元以上的并处5倍以上10倍以下罚款，不足5万元的并处20万元以上50万元以下的罚款，情节严重的吊销许可证。

草案中则规定，发行、放映未取得《电影公映许可证》的电影，或提供参加电影展的将被吊销许可证(the licence will be revoked)，没收违法所得(all illegal gains will be confiscated)并处10倍以上20倍以下罚款，违法所得不足5万元的可并处50万元以下罚款。

Also, the draft calls a stop to advertising input during the time of film screening, and has clear punishment rules on the behavior of "stealing box office."

此外，该草案还要求影院在放映电影期间不插播广告。而针对“偷票房行为，草案也明确了惩戒措施。

草案规定，电影院在向观众明示的电影开始放映时间(movie showtimes)之后至电影放映结束前放映广告的，由县级人民政府电影主管部门给予警告，责令改正;情节严重的，处以1万元以上5万元以下的罚款。电影院未如实统计销售收入(sales)的，由县级政府电影主管部门处5万元以上50万元以下罚款;情节严重的，责令停业整顿(suspending business operations);情节特别严重的，由原发证机关吊销许可证。
