最高法发文保护司法人员履行职责

为贯彻落实中共中央办公厅、国务院办公厅印发的《保护司法人员依法履行法定职责规定》，最高人民法院日前发布了《人民法院落实〈保护司法人员依法履行法定职责的规定〉的实施办法》（以下简称《办法》），并同步发布司法人员履职保障十大典型案例。

The Supreme People's Court on Tuesday published a document on improving the mechanism to protect judges and their associates in fulfilling their legal duties. It stipulates that when handling cases, judges should not be subject to interference from other government organs, social organizations or individuals.

最高人民法院7日发文，落实保障司法人员依法履行职责的机制。文件强调，法官办案时不受行政机关、社会团体和个人的干涉。

《办法》共二十四条，涉及免受干预（free from interference）、免责机制（mechanism of accountability exemption）、救济渠道（redress mechanism）、公正考核（impartial assessment）、安全保障（safety protection）、休假权利（vacation entitlement）、薪酬保障（salary guarantee）等内容，是对《保护司法人员依法履行法定职责规定》的细化和落实。

内容要点包括：

Judges have the right to refuse to follow any requests by any organization or individual that are without legal mandate or due process.

法官有权拒绝执行任何单位、个人违反法定职责或者法定程序、有碍司法公正的要求。

Judges are also entitled to refuse to comment on cases which are not in a judicial process or trials that they do not participate in.

法官有权拒绝就尚未进入诉讼程序的案件或者本人未参与审理的案件发表意见。

They are entitled to make complaints against nine types of action by governmental agencies or staff, including intervention in judicial process, obstruction of justice and restraint or suppression of the judges' independent expression of opinion.

法官有权对国家机关或工作人员的九种行为提出控告，包括：干预司法活动；妨碍司法公正；限制或者压制法官独立、充分表达对参与审理案件的意见；等等。

All courts should have committees to protect judges' safety, rights and interests.

所有法院都应设立保护法官安全和权益的委员会。

Judges and their associates should also be provided with recording devices at their workplace.

应该为法官和司法人员提供录音录像设备。

Those found guilty of interfering in judicial affairs, including threatening, insulting or harming judges, will face severe punishment.

威胁、辱骂或伤害法官等干预司法公正的行为将受到严惩。

Personal information of judges and their families should be protected.

法官及其家属的个人信息应受到保护。
