　　17. There are two types of laws: just and unjust. Every individual in a society has a responsibility to obey just laws and, even more importantly, to disobey and resist unjust laws.

　　a) 在民主社会中，法律的作用是。但是法律有时候可以被认为是just和unjust的。

　　b) 对于不同的利益群体来说。比如污染环境的工厂，环境保护法要求进行污染治理，增加的成本造成工资下降和失业，工人利益因为法律而受到损害，认为法律unjust，而周围的居民则认为法律是just

　　c) 对不同文化背景和宗教背景的人来说。比如刚移民到美国的亚洲人，也许在教育孩子时有点暴力是可以的，但是当地人肯定认为这是家庭暴力。被法律惩罚的亚洲父母认为法律是unjust

　　d) 但是法律不仅仅规定了行为，还给了合法的途径去改变，废除法律。如果disobey和resist，只能降低法律权威和造成非理智的冲突，危害社会稳定，举刚才工厂的例子，村民与工人的冲突。

　　174. Laws should not be rigid or fixed. Instead, they should be flexible enough to take account of various circumstances, times, and places.

　　a) 科技经济在不断的发展，新的技术和新的经济行为需要法律做出适当的修改，来保护人们的利益。//反垄断法，反对克隆的法律，antitrust law， Nineteen European nations on January 12, 1998, approved the first binding international treaty prohibiting the cloning of human beings.

　　b) 社会在发展，道德标准也在变化，法律必须做出修改以适应新的社会.//美国宪法的修正案，妇女权利黑人权利的保护，Lincoln enacted the law to entitle equal rights to the blacks with the whites.

　　c) 但法律的基本精神和框架短时间内不能变化，否则会破坏社会的正常运作，也降低了法律的权威。//把汽车形式方向突然改变，造成多少交通事故，人们对国家的不信任

　　178. It is possible to pass laws that control or place limits on people s behavior, but legislation cannot reform human nature. Laws cannot change what is in people s hearts and minds.

　　【Position】: Laws are enacted to control or alter people s behavior, thus it can indirectly influence the way people think for laws teach us right from wrong.

　　a) 法律规定了什么事情可以做，什么事情不能做。保护了人们的基本权利河合法利益，维护了社会稳定

　　b) 通过对人们行为的约束，可以潜移默化的改变人们对于善恶的看法。//法律禁止私自限制他人自由，通过对违法事件的惩罚是人们总内心认为这样做是不对的，也是人们自觉的维护自己的自由。

　　c) 不能用法律把某种思想强加与人，不能限制人们思想的自由，压制人们的言论自由使得民主遭到破坏，滋生独裁与集权。
